Terms of Service

These Terms of Service (“Terms”) are an agreement between you and CatchBag (“CatchBag”, “we”, “us”), the operator of the CatchBag website at catchbag.co.nz, the CatchBag web portal, and the CatchBag mobile app (together, the “Service”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Service.

CatchBag currently includes:

• catch logging with photos and AI species recognition;
• trip planning and live GPS trip tracking;
• fishing events and competitions with leaderboards, and hunting trip planning;
• maps, weather, and tide information; and
• “Mr. Hook”, our AI assistant (chat and voice).

We’re always improving CatchBag, so we may add, change, limit, or remove features at any time — including moving features between free and paid tiers. Where a change significantly reduces what you can do, we’ll do our best to give you notice in the app first.

• CatchBag uses passwordless sign-in: you enter your email and we send you a one-time login code. Your account is created the first time you verify a code.
• Because your email is the key to your account, keep access to it secure. Anything done after signing in with your code is treated as done by you.
• You must be at least 18 years old to create an account or use the Service.
• Keep the details on your profile accurate.
• We may suspend or close accounts that breach these Terms (see section 12).

You can delete your account at any time from catchbag.co.nz/delete-account. Deletion is immediate and permanent.

• Every new account gets a free trial (currently 14 days) with full access to paid-tier features. When it ends, your account moves to the free tier, which has usage limits on some features.
• We may change the trial length, what each tier includes, and free-tier limits at any time.
• CatchBag doesn’t currently take payments. When paid subscriptions launch, separate purchase terms (including pricing, renewal, and refunds) will apply and will be shown to you before you buy anything.
• Event entry fees are arranged directly between you and the event organiser, outside CatchBag — see section 7.

You own the content you add to CatchBag — catch logs, photos, GPS tracks, trip plans, event entries, and messages. You grant CatchBag a licence to host, store, display, and process that content as needed to operate and improve the Service, including for the AI features you choose to use.

Be aware of what other people can see:

• catches you log can appear on the community catch map;
• catches entered into an event appear on that event’s leaderboard, visible to other participants;
• if you opt in to sharing your path on a group trip, other trip members can see your live location;
• trip and event invite links (including QR codes) show a preview — name, dates, cover image, and creator — to anyone who has the link, without logging in.

You’re responsible for your content, including having the right to upload any photos you share. We may remove content that breaches these Terms.

When using CatchBag you agree not to:

• log false or misleading catch data, especially in events and competitions where leaderboards and prizes are involved;
• post content that is unlawful, harassing, or infringes someone else’s rights;
• scrape the Service, interfere with its operation, or attempt to access accounts or data that aren’t yours; or
• use the Service to break any law or regulation.

• Events on CatchBag are created and run by organisers. CatchBag provides the platform but is not a party to any event.
• Entry fees, prizes, and payouts are arranged between you and the organiser. CatchBag doesn’t process event payments and isn’t responsible for them.
• When you join an event, the organiser can see your name and phone number so they can run the event.
• Organisers set their own event rules, including any age limits, which apply in addition to these Terms.
• Disputes about scoring, prizes, or event conduct are between you and the organiser. We may help where we reasonably can, but we’re not obliged to resolve them.

• Mr. Hook’s cloud features (chat, photo species identification, and voice) are powered by a third-party AI provider, OpenAI. Messages, photos, and voice audio you submit to those features are processed by OpenAI. The optional offline model runs entirely on your device. See our Privacy Policy for details.
• AI output can be inaccurate. Species identification, rule and permit summaries, and fishing or hunting advice are provided to help — they are not a substitute for checking official regulations or using your own judgement.

• Maps in CatchBag, including nautical chart layers, are for general information only and must not be used for navigation.
• Weather and tide information comes from third-party providers and can be wrong, delayed, or unavailable. Always check official forecasts and make your own safety decisions before heading out.
• Fishing rules shown in the app (such as size and bag limits) and hunting information (such as permit requirements and seasons) are informational. You are responsible for knowing and complying with the actual regulations that apply where you fish.
• Fishing, hunting, boating, and other outdoor activities carry inherent risks. You take part at your own risk.

The Service relies on third-party providers, including Mapbox and LINZ (maps), weather data providers, OpenAI (AI features), Google Firebase (notifications and crash reporting), Amazon Web Services (photo storage), Resend (email), and Sortd (support chat). We don’t control these services and can’t guarantee their availability or accuracy.

Event area maps include coastline data © OpenStreetMap contributors, available under the Open Database License (ODbL).

How we collect, use, and share your personal information — including location data and data processed by AI features — is set out in our Privacy Policy, which forms part of these Terms.

• You can stop using CatchBag at any time.
• To delete your account, email support@catchbag.co.nz from your account email. Deletion removes all of your account data — your profile, catches, photos, trips, event history, AI conversations, and notifications.
• We may suspend or close your account if you seriously or repeatedly breach these Terms. Where reasonable, we’ll warn you first.

• The Service is provided “as is”. We don’t promise it will be uninterrupted, error-free, or that data (including GPS tracks and catch logs) will never be lost — keep your own records of anything important.
• To the maximum extent permitted by law, we’re not liable for indirect or consequential loss, lost prizes, or loss of data arising from your use of the Service.
• Nothing in these Terms limits rights you have under the Consumer Guarantees Act 1993 or any other law that we cannot lawfully exclude. If you use the Service in trade, the Consumer Guarantees Act 1993 does not apply to the extent permitted by law.

We may update these Terms from time to time. The “Last updated” date at the top shows the current version. For significant changes we’ll do our best to notify you in the app or by email. Continuing to use the Service after a change means you accept the updated Terms.

These Terms are governed by New Zealand law, and the New Zealand courts have jurisdiction over any dispute. Contact us at support@catchbag.co.nz.
